General Provisions
§ 1.
The service provider is ComCERT SA, with its registered office in Warsaw at 13 Branickiego St., 02-972 Warsaw, registered in the Polish National Court Register under (KRS) number: 0000406425, Polish Tax Identification Number (NIP): 5252524691, Polish Statistical Number (REGON): 145934931, with share capital of PLN 136,000.00 (one hundred and thirty-six thousand zloty), fully paid up.
This Terms and Conditions document is a regulation within the meaning of Article 8 of the Act of 18 July 2002 on the provision of electronic services.
The Terms and Conditions specify the type and scope of electronic services provided by the service provider, the conditions for their provision, as well as the rules for concluding and terminating distance contracts for the provision of services, including the complaint procedure.
Definitions
§ 2.
Email address – the email address used by the service recipient.
Agreement – the contract for the provision of electronic services concluded between the service provider and the service recipient under the terms set out in these Terms and Conditions.
Services – informational and communication services provided using a telecommunications system.
Service Recipient – a person communicating with the service provider via the contact form available on the website https://www.comcert.pl/en/https-www-comcert-pl-en-mainpage/.
Service Provider – the entity providing electronic services, namely ComCERT SA, which is a party to the electronic services agreement.
Services
§ 3.
The Service Provider provides informational and communication services using a telecommunications system.
The Agreement is concluded through contact with the Service Provider via:
the contact form available on the website https://www.comcert.pl/en/https-www-comcert-pl-en-mainpage/ and its subpages, tabs;
the incident reporting form available at https://www.comcert.pl/en/incident-reporting-form/;
creating an account in the shareholders’ portal by contacting the email address: [email protected].
Ordering the Services by the Service Recipient constitutes acceptance of the Terms and Conditions.
The Service Recipient may use the services provided that they meet the technical requirements specified in § 4 of the Terms and Conditions.
Technical Requirements for Using the Services
§ 4.
The condition for proper use of the Services is that the service recipient has an IT system meeting the following minimum technical requirements:
access to the Internet (connection speed of at least 128 kb/s for the user);
possession of an email account;
an up-to-date version of a web browser.
The Service Provider shall not be liable for technical problems or limitations of the Service Recipient that prevent the Service Recipient from using the Services.
In the event of the inability to properly perform the Services due to technical reasons beyond the control of the Service Provider, the Service Recipient shall have no claims against the Service Provider.
Withdrawal from the Agreement
§ 5.
Each party to the Agreement has the right to withdraw from the Agreement.
The statement of withdrawal must be submitted in a manner that allows the other party to become acquainted with it before the commencement date of the Services.
In the event of a valid exercise of the right of withdrawal, the Agreement shall be considered as not concluded.
Rights and Obligations of the Parties
§ 6.
The Service Provider shall not be liable for interruptions in the provision of the Services or for the lack of access to the Services due to causes beyond the Service Provider’s control.
The Service Provider reserves the right to temporarily suspend the provision of the Services for maintenance of the website, software, and technical equipment.
The Service Recipient has the right to submit complaints in accordance with the provisions of § 7 of the Terms and Conditions specified below.
The Service Provider is subject to a statutory prohibition on providing unlawful content.
Complaints
§ 7.
Complaints must be submitted no later than 7 (seven) days from the day the cause for filing the complaint occurred.

to the Service Provider’s registered office: ComCERT SA, 13 Branickiego St., 02-972 Warsaw.
Complaints without specified justification will not be considered.
Final Provisions
§ 8.
These Terms and Conditions shall be effective from September 22 2025.
The Service Provider reserves the right to amend the Terms and Conditions:
due to the necessity to adapt the provisions of the Terms and Conditions to applicable legal regulations or decisions of competent public authorities;
as a result of changes in the interpretation of generally applicable law affecting the content of the Terms and Conditions;
following court rulings, decisions, recommendations, or guidelines of relevant offices or authorities in the given scope;
due to the need to correct errors or typographical mistakes in the Terms and Conditions;
due to changes in data, including, for example, contact details, names, or contact information.
All changes to the Terms and Conditions shall come into effect on the date of their publication.
